| The meeting convened at 1:28 PM. Present
were Timothy P. Stone, Louis Fazen, III, Ruth C. Brefka,
Public Health Director Paul C. Pisinski and Secretary Barbara
M. Luther.
The minutes of the March 2, 2005 were approved with some
corrections. Mrs. Brefka asked about licensing liquor stores
with a food license. It was explained that some sell hotdogs
and others sell prepackaged foods and therefore need a Limited
Food Establishment License.
Vouchers totaling $469.82 were approved for payment from
the Board of Health Budget.
Members were briefed on the agenda and any scheduled appointments.
DISCUSSION
During a discussion regarding the food licenses, listed
in the March Minutes, Mr. Pisinski explained to the other
Board Members that Dr. Fazen had advised him that he had
heard that there might be money available from the Department
of Public Health’s Emergency Preparedness account
to hire someone to help with the food inspections, which
are required by the state. Some restaurants/food establishments
must be inspected four (4) times per year, while others
are inspected twice per year. Mr. Pisinski will contact
the Region 4A liaison to the Department of Public Health,
Beverly Anderson to see if this is still possible.
Southborough Tobacco Compliance Checks
A copy of the March 23, 2005 Tobacco Compliance Check Report
was given to each member. Mr. Pisinski pointed out that
the town had 100% compliance during ten (10) attempts to
purchase cigarettes by a seventeen (17) year old male, not
one establishment agreed to sell to him. Dr. Fazen suggested
that a letter of congratulations be sent to all those holding
licenses to sell tobacco. Dr. Stone stated that he felt
that the heart of the program should be in education to
prevent kids from ever stating to smoke. It was decided
that the Board should determine who is responsible for the
curricula in grades K through 12 and see what, if any programs
they might have.
Public Health Director to begin “Stinky
Stream” Investigations beginning April 20, 2005 with
Amy Hunt of Fuss and O’Neil
Mr. Pisinski recounted the several “stinky stream”
complaints received over the past few years, as well as
his finding, regarding a stream that begins in the swampy
area in the vicinity of Ward Rd., Bigelow Rd. and Main St.
and continues across Johnson Rd. and ultimately into the
aqueduct. Because of these complaints the Board of Selectmen
have given the Board of Health funds to hire the firm of
Fuss & O’Neil to sample and test the stream to
see if the source of pollution can be discovered and corrected.
Mr. Pisinski will make the first walk with the representative
from Fuss & O’Neil on Wednesday, April 20, 2005.
Mr. Pisinski has begun to plot all the septic systems in
the area, and did find a drainage pipe that crosses a septic
system, however he would like to wait until the results
of the test are available before doing anything more.
Public Health Director’s letter regarding
renewal or extension of contract
Mr. Pisinski would like to extend his employment contract
with the Board of Health. Under that contract he is required
to notify the Board, formally at least one year prior to
the end of his contract if he chooses to remain. Dr. Stone
stated that he felt he should withhold any of his comments
because he will no longer be on the Board after the May
9th election. Mr. Pisinski explained that he did not expect
any decision to be made at this meeting he simply wanted
to fulfill the formal notification requirements. He read
into the minutes his memo, dated April 14, 2005 and entitled
“ Pre-Renewal Notice for Public Health Director Employment
Contract” (copy attached to these minutes). At a future
meeting he will provide the members with an outline asking
for a one-year renewal of his contract starting July 1,
2006 and ending June 30, 2007. Beginning July 1, 2007 he
would like to work part-time (less than 19 hrs per week)
as an agent. As a part-time employee he would assist in
training a new full time Agent and continue all Title 5
activities.
Dr. Fazen asked if it is even possible to hire another person
during Mr. Pisinski’s part-time employment. Mr. Pisinski
explained that with him working fewer hours, and a new full-time
person starting at an entry-level rate, the cost to the
town would be about the same as it is under this contract.
Mrs. Brefka asked if this was protocol, and had been done
before, expressing concern that it might be difficult to
get someone new to agree to this arrangement. The newer
members of the Board were advised that Mr. Pisinski began
his employment at Southborough as an agent not as Public
Health Director, and that it would not be unusual to start
a new employee at the agent position/grade. Mr. Pisinski
could assure that the new person got all the necessary certifications
over a 2 to 3 year period of “training”.
Grade Change/Salary Increase for the Secretary
Dr. Fazen asked what the status was of the Board’s
approval for the Secretary’s grade 2 classification
to be changed to Administrative Assistant grade 3 and the
subsequent increase in salary. The Board of Health recommendation
had to be submitted to the Union and to the Board of Selectmen.
Mrs. Luther advised that the Board of Selectmen had approved
the change in grade at the rate requested. Town Meeting
had approved the Board of Health Budget with the new hourly
rate to go into effect as of July 1, 2006.
2 Woodland Rd. – Minor Site Plan Review Report
Mr. Pisinski wished to update the Board members concerning
the situation at 2 Woodland Road. No action was needed at
today’s meeting but he indicated the Board might need
to initiate court action with our Town Counsel in the near
future if the owner(s) of the property (Mr. Heavey as Trustee)
do not move fast enough.
Mr. Pisinski briefed the Board of Mr. Heavey’s history
at this property and adjoining properties as follows:
1. Mr. Heavey, as Trustee, purchased the property with several
buildings in the mid 1990’s. He proceeded to clear
trees and brush from the property, within the wetland or
in very close proximity of the wetlands. The Southborough
Conservation commission cited Mr. Heavey for violations
to the State Wetlands Protection Act – and mandated
that he take action to restore the wetlands he damaged.
2. Mr. Heavey, according to Southborough Conservation Commission
minutes, has still not complied with the Commission’s
enforcement orders as of April 2005.
3. The Southborough Board of Health approved Complete Replacement
Septic Systems for the two apartment buildings on the site
and the one old storage/commercial building at the corner
of Woodland Rd. and Route 9. All three existing septic systems/cesspools
were found to be in failure.
4. Mr. Heavey, through his Attorney, informed Mr. Pisinski
that Mr. Heavey would like to install the new septic systems
but has “had some difficulty with the Conservation
Commission.” The proposed septic systems will require
construction within close proximity to the wetlands. Any
such construction will require a filing with the Conservation
Commission and ultimate “Order of Conditions”.
However, the most recent meeting minutes continue to inform
Mr. Heavey that he has several “outstanding orders”
that he has ignored and that he must comply with those existing
orders first before they will entertain a new order of conditions.
5. Mr. Pisinski indicated that now that the winter septic
system installation with its moratorium on selected systems
is now over, he would expect Mr. Heavey to begin showing
some sign of activity to replace these failed systems. Mr.
Pisinski said he would keep the Board informed. (as submitted

Dr. Timothy P. Stone’s last Board of Health
Meeting SURPRISE!
“Doc” Stone was celebrated with a surprise party
at the end of the regularly scheduled Board Meeting. His
wife Virginia was secretly brought to the meeting and one
by one several town officials arrived to offer their best
wishes and express their appreciation for Doc’s 58
years of service to the Town of Southborough. Among the
well wishers were Bob Kimball, from the State Department
of Environmental Protection, Philip G. Mauch, former long
time Chairman of the Southborough Board of Health, Janice
Conlin, Southborough Town Administrator, John Bolland, Superintendent
of the Southborough Department of Public Works, Fire Chief,
John Mauro, as well as department heads and several town
employees that have had the pleasure of working with Doc
over the years of his service. Board of Health Member, Ruth
Brefka expressed her appreciation of Doc and Board of Health
Member, Louis Fazen III, MD read a proclamation commending
the many accomplishment and service of Dr. Stone. Public
Health Director, Paul C. Pisinski said that it had been
a delight to work with Doc, and Board of Health Secretary,
Barbara M. Luther said that working for Doc was one of the
best experiences she has had. The audience also shared stories
and appreciation. Dr. Timothy P. Stone’s wit, wisdom
and discernment will be greatly missed.
